HUFF AND PARKS decided to make a dramatic move, perhaps the most important of the entire case, and in the middle of July filed a motion to change the site of Darlie’s trial. Dallas County had been so saturated by publicity that a fair hearing of the charges against her “is rendered either impossible or highly unlikely.” Tolle scheduled a hearing in September, at which time he would weigh the arguments.

Prosecutors, too, filed a motion about the same time, seeking to add the death penalty to the case against Darlie Routier. Even in Texas, calling for a death sentence is difficult except in certain types of cases that are specifically spelled out, such as the death of a police officer or firefighter, a murder committed during a felony, or multiple murders. The legislature, however, had only recently tagged another clause to that list: the death penalty could be sought when the victim is a child under the age of six. The prosecutors were planning to split the charges against Darlie and go after her first on the capital murder charge involving five-year-old Damon. If they lost, they could always retry Darlie for the death of Devon. Tolle added that motion to the growing list of motions that he would decide in September.
